CASE is preparing to issue a revised set of contracts for use by our engineering
professionals. The CASE Contracts Committee develops and maintains contract
templates and commentary consistent with the CASE “Ten Foundations of Risk
Management.” There are 12 agreement templates and 3 commentary templates.
Examples of some of the documents are “Agreement for the Provision of Limited
Professional Services,” “Agreement for Use with and Commentary on AIA Document
C401 Standard Form of Agreement Between Architect and Consultant,” and “Agreement
Between Structural Engineer of Record (SER) and Contractor for Transfer of Digital
Data, Computer Aided Drafting (CAD) or Building Information Modeling (BIM), Files.”
The new contracts contain certain “must have” Terms and Conditions along with an
important new clause titled “Claim Validation.” The session will provide an overview of
the CASE agreement templates, including background on and reasoning for the updates,
and when and how to use them. Also covered in the session will be an explanation of the
new Terms and Conditions and the Claim Validation clause.
