In 2018, surveyors cited over 100,000 federal deficiencies in nursing homes nationwide. Recognizing that not every deficiency is either factually accurate or represents non-compliance with regulations, CMS requires each state survey agency to have a process in place which permits nursing facilities to challenge deficiencies. Understanding the informal dispute resolution process (IDR) empowers leaders in nursing homes to effectively advocate for their facilities.
For 12 years, Bill Vaughan, RN was the Chief Nurse of the Maryland state survey agency where he oversaw the agency’s IDR process. Bill will highlight various aspects of the IDR process focusing on fact pattern analysis, regulatory requirements and standards of care. The rights and responsibilities of facilities in the IDR process will be explored. Case studies from actual IDRs will be shared and recommendations to improve IDR outcomes will be presented.
