3218 - CyberTheft of Trade Secrets and Attorneys’ Ethical Considerations to Data Breaches

From solo entrepreneurs to Fortune 100 companies, trade secrets may be a most valuable asset and of importance in the global economy: According to the U.S. Chamber of Commerce, trade secrets make up 70 percent of the value of U.S. public companies' portfolios. Not surprisingly, such secrets are theft targets from domestic and foreign competitors. Estimates of theft of American intellectual property is north of $300 billion. A recent survey revealed that half of the respondents admitted to taking corporate data when they left their employer and almost two-thirds transferred corporate data to personal devices and never deleted the same. This presentation discusses the legal aspects of trade secrets, details some famous or recent cases as well as relevant legislation. The last part of the presentation covers general ethical considerations of attorneys when responding to a security breach.
