Mark Regan, Managing Partner, Hooper Lundy and Bookman, P.C., Bill Wilson, Partner, Wilson Getty LLP, and James Seagroves, Partner, Reed Smith LLP, will provide an overview of arbitration best practices as well as discuss key points of the Aon professional liability study. They will also introduce an Arbitration One Sheet for use during the admissions process.

9:45am – 11:00am – Payment Policy Pressures and How They Influence Partnerships
This session will focus on changes in hospital and physician payment systems which are impacting hospital and physician provider behavior with SNF providers and will include highlights on the impacts of resource use and the outlook for future hospital and physician payment system changes and likely impacts on SNF providers. Leading the discussion will be Alex Bardakh, Director, Public Policy and Advocacy at AMDA-The Society for Post-Acute and Long-Term Care Medicine and Rochelle Archuleta, Policy Director, American Hospital Association.
Discussion topics will focus on:
1. How relationships with SNF providers changed due to payment system changes, SNF referral patterns, occupancy, and length of stay
2. The top five “must dos” as a SNF to be the best partner to hospitals and physicians
3. The issues that will become increasingly important in terms of SNF partnerships

Fred P. Benjamin, FACHE

Fred Benjamin is the President of the Skilled Nursing and Post-Acute Care Division of Lexington Health Network, a Chicago-area provider of Skilled Nursing and Rehabilitation, Assisted and Independent Living, and other services. Previously, Mr. Benjamin served as Chief Operating Officer and Board Member at Medicalodges, Inc., also a provider of Skilled Nursing and other Post-Acute Care services. During his 30-year career he has served as a senior executive and Board Member at hospitals, post-acute care, insurance, and managed care organizations. He has operated health care services in not-for-profit, investor-owned and employee-owned organizations.
During his tenure at Medicalodges, he oversaw the development and implementation of the company’s Quality Improvement Program, which resulted in 27 of 30 communities earning an American Health Care Association Quality Award as well as 11 facilities being named “Best in America” by US News and World report. He also served as Chairman of the Board of Directors of the Kansas Health Care Association and as a Member of the Board of Directors of Sunflower State Health Plan, an affiliate of Centene, Inc. one of three Managed Care organizations serving the Kansas Medicaid program.
He has also represented the American Health Care Association and US Chamber of Commerce, testifying before the United States Senate Judiciary and Veteran’s Affairs Committees as well as the US House of Representatives and other Federal Agencies. He currently serves as Co-chair of the AHCA’s Regional Multi-Facility Council and as a member of the Reimbursement Committee.
He has been the recipient of many honors and recognitions including being elected as a Fellow of the Institute of Medicine of Chicago and as a Fellow of the American College of Health Care Executives (FACHE). He has been happily married for 37 years and is the proud father two fantastic children.

Mark Reagan is the managing partner of the San Francisco office of Hooper, Lundy & Bookman, P.C. He is general counsel for the California Association of Health Facilities and the Massachusetts Senior Care Association. He is also a member of the legal committee of the American Health Care Association. Mr. Reagan was previously chair of the legal committee for four years.

Mr. Reagan's practice is devoted to counseling, litigation, trial and appellate work before administrative agencies and all courts and specializies in the areas of post-acute and long-term care, Medicare and Medicaid reimbursement, managed care, health care fraud and elder abuse, licensing and certification, and corporate compliance. He frequently testifies before state legislatures on these and other health-related matters and assists clients with legislation and regulatory enactments.

James Segroves is a partner resident in the Washington, DC office of Reed Smith LLP. He represents members of the health industry, trade associations, and other clients in important, precedent-setting cases at the trial and appellate levels of court systems throughout the United States, as well as matters before administrative tribunals. These cases range from significant False Claims Act (FCA) matters based on complicated regulatory theories, appeals from adverse jury verdicts in cases presenting legal questions of first impression, reimbursement disputes involving hundreds of millions of dollars, substantive and procedural challenges of agency regulations, and matters before the Supreme Court of the United States with nationwide consequences.

James also provides clients with guidance on legislative matters pending before Congress on topics such as Medicare, Medicaid, the FCA, and arbitration, as well matters under consideration in the federal rulemaking process.

William C. Wilson is a founding partner of the firm and holds an “AV” rating by Martindale Hubbell. He attended the University of San Diego School of Law (J.D., 1990), and the University of North Carolina at Chapel Hill (B.A., 1985). While in law school, Bill participated in the Tort and Evidence Law Moot Court Competitions, and interned with the San Diego City Attorney’s Office.

Bill’s practice is devoted to the defense of all types of healthcare providers. It includes representation of physicians and the entire spectrum of post-acute providers. On behalf of these defendants, he has successfully tried, arbitrated and mediated numerous actions with claims of professional negligence, malpractice, and elder abuse/neglect filed by residents and family members. Bill regularly represents facilities in administrative hearings involving alleged regulatory violations. He spends significant time advising long term care clients in risk management strategies and on corporate compliance issues.

Bill’s published opinions in long term care litigation include Laswell v. Country Villa, a case that helps the long term care profession enforce executed binding arbitration agreements and Nevarrez v. San Marino, a case of first impression that limits recoverable damages in cases that include claims for violations of California Health and Safety Code section 1430(b) and narrows the admissibility of DPH citations in civil actions.

Bill is a long time active member of the California Association of Health Facilities, Litigation Subcommittee.

Tory Starr, MSN, PHN, RN

Valley Area/ Sutter Health

Tory Starr is the Vice President for Care Management for the Sutter Health System, Valley Area. In his role he has responsibility for a broad span of functions across the continuum of care involving care coordination. These responsibilities include case management, social services, palliative care, and post acute care. The Valley Area of Sutter Health includes 10 acute care hospitals and five medical groups serving more than 4 million people.

He has been involved in the field of performance/ quality improvement for more than three decades in both the acute and community health care settings. His professional focus has been on organizational development and change management as his organizations have navigated the turbulent waters of health care transition. He works closely with medical staff, hospital leadership and the clinical departments of both acute care and ambulatory care facilities to continuously improve the quality and effectiveness of care and service delivery to the Valley Operating Unit of Sutter Health. His three decades in nursing practice has included community and home health, acute care and academia. He is past member of the faculty at Humboldt State University (HSU) in the Department of Nursing teaching senior level students in community/ public health.

He received his baccalaureate degree in Nursing from HSU, his Masters degree in Nursing from Walden University and has specialty certification in Infection Prevention. He is a 2012 graduate of the California Health Care Foundation’s Health Care Leadership Program.

As part of his research work, he created and implemented the Care Transition Program. The Care Transition Program has been identified and supported by a wide variety of foundations for its novel approach to improving patient safety by facilitating transitions across the continuum of care including the Robert Wood Johnson and Cardinal Health Foundations and the State of California.
