92 - Of Disputes and Dialogues: Non-state Actors and the Maintenance of Peace and Order in India

Social groups often respond to violence, disputes, and transgression of norms by setting afoot a plethora of micro-processes that not only take form in customary dispute-settlement forums such as panchayats [councils], but also through informal personal interactions, exchange and gift-giving practices, collective mourning, etc. These micro-processes emerge at multiple sites and around a spectrum of social groups such as familial units, religious organizations, caste and village panchayats, or urban residential associations. Further, they are characterized if not by a complete absence of state institutions, and their actors, then at least by their peripheral or intermittent participation. This panel brings together four papers that offer ethnographic insights not only about the nature and processes of nonstate sites and modes of arbitration, conflict resolution, and maintenance of peaceful relations but also about the character of violence and disputes which these sites and modes respond to. These papers raise important questions about the role played by such nonstate practices and mechanisms and examine what the very terms of conflict resolution and maintenance of peaceful relations mean in different sites. Finally, the panel pays specific attention to the combination of diverse strategies and processes. Through these questions, it stresses the importance of looking at variations in nonstate modes of addressing conflict and potential tensions, in contrast to studies on South Asia that tend to depict customary dispute settlement forums and informal local modes of avoiding and dealing with tensions as static, unquestionably influential among local communities, and clearly distinct from state institutions and approaches.
