2216 - Law, Cybercrime and Cybersecurity: Developments, Problems and Potential Solutions

The law is continually evolving with respect to cybercrime and cybersecurity, yet it is not keeping pace with the rapid changes of technology and crime. Law enforcement and criminal law are struggling to adapt to the international face of cybercrime, an adaptive and capitalistic economy that is immensely profitable and difficult to investigate. Civil laws and government regulations are slowly reacting to the new threats and are struggling to protect consumer privacy, require businesses to provide adequate security and apportion civil responsibility following a significant cybercrime. Our society engages in vigorous debate about privacy, security, investigative and legal issues such as surveillance and encryption.

This talk discusses developments in cybercrime and cybersecurity law and practice, and explores the dilemmas we face and paths forward.

John Bandler Esq., CISSP, is founder of Bandler Law Firm PLLC and Bandler Group LLC, a law firm and a consulting practice to help businesses and individuals with cybercrime investigations, cybersecurity, traditional investigations and other areas. He has more than 20 years of diverse government experience, first as a state trooper in the New York State Police, then as an assistant district attorney in New York County and also as an Army Reserve officer. At the district attorney's office he investigated and prosecuted a wide variety of criminal offenses including global cybercrime, data trafficking, and digital currency money laundering. John holds a number of information security and information technology certifications (including CISSP), and writes, lecture, and teaches on cybersecurity, cybercrime, investigations, and the law. He is the author of the book recently published by the American Bar Association called Cybersecurity for the Home and Office.
